
The Environmental Protection Agency (EPA) created the Endangerment Finding in 2009 following the Massachussetts vs the EPA Supreme Court Case. The Endangerment Finding, following the determination that Greenhouse Gas Emissions can cause public health endangerment, has required the EPA to regulate U.S. emissions (from vehicles, power plants, etc.) for approximately the past 17 years.
This February, the EPA issued a “rule” that rescinded the Endangerment Finding based on the ‘legal interpretation being wrong.’ This decision can have detrimental impacts on the environment across the United States, and locally in Virginia.
The Chesapeake Bay is vulnerable to the effects of the rescission of the Endangerment Finding due to sea level rise and sea pollution, where Bay cleanup efforts may be set back tremendously, according to Baynet. The health of the Chesapeake Bay is especially important as it is one of Virginia’s three primary watersheds. Watershed health is valuable to thriving ecosystem biodiversity and and drinking water quality, which can both be easily degraded with pollution.
On March 25, Attorney General of Virginia Jay Jones challenged the EPA’s decision, stating that the scientific evidence must continue to be placed at the forefront. As of April 16, sixteen health and environmental groups filed a petition with the EPA to repeal incorrect claims of the rescission of the Endangerment Finding. The petition also noted how the rescission does not abide by the 1970 Clean Air Act.
